本《用户个人数据保护及隐私政策》（以下简称“本政策”或“本隐私政策”）适用于），知音楼旗下所有的产品及服务（以下简称“知音楼”或“平台”您通过平台的产品及服务而接入的其他第三方产品或服务除外。请您务必在点击同意本政策之前，审慎阅读、充分理解各条款内容，特别是免除或者限制责任的条款、法律适用和争议解决条款。免除或者限制责任的条款将以粗体标识，您应重点阅读。如您对政策有任何疑问，可按照本政策列明方式与知音楼取得联系。
This "User Personal Data Protection and Privacy Policy" (hereinafter referred to as "the Policy" or "the Privacy Policy") applies to all products and services under Zhiyinlou (hereinafter referred to as "Zhiyinlou" or the "Platform"), except other third-party products or services that you access through the Platform's products and services. Please be sure to carefully read and fully understand the contents of each term, especially the terms of exemption or limitation of liability, application of laws and dispute resolution, before clicking to agree to the Policy. 当您点击确认同意本政策，即表示您已充分阅读、理解且接受本政策的全部内容，并与知音楼达成一致，本政策对您及知音楼均具有法律约束力。
When you click Confirm to agree to the Policy, it means that you have fully read, understood and accepted all the contents of the Policy and reached an agreement with Zhiyinlou. The Policy is legally binding on you and Zhiyinlou.

1.知音楼旗下产品及服务：指北京世纪好未来教育科技有限公司通过下述途径向您提供的产品及服务：包括但不限于知音楼网站、移动应用、客户端、相关微信开放平台账号或小程序以及供第三方网站和应用程序使用的知音楼软件开发工具包（SDK）和应用程序编程接口（API）、未设独立隐私政策的知音楼关联公司提供的产品及服务等。
1. Products and Services under Zhiyinlou: Refers to the products and services provided to you by Beijing Century TAL Education Technology Co., Ltd. through the following channels: including but not limited to zhiyinlou.com, mobile applications, clients, related WeChat open Platform accounts or applets, Zhiyinlou software development kit (SDK) and application programming interface (API) for third-party websites and applications, products and services provided by affiliated companies of Zhiyinlou without independent privacy policies, etc.
2.其他第三方产品或服务：包括但不限于知音楼以外的其他交易相对方、第三方网站以及第三方服务提供者为您提供的产品或服务。
2. Other third-party products or services: including but not limited to products or services provided to you by other counter-parties, third-party websites and third-party service providers other than Zhiyinlou.
3.关联公司：指好未来教育集团（TAL Education Group）最新上市公司年报披露的好未来教育集团的关联公司。

4.合作伙伴：指知音楼服务提供过程中涉及的第三方信息系统、支付机构、微信/QQ/微博等用于第三方登录的社交平台，以及知音楼为实现部分功能、提供更好的客户服务和用户体验而进行合作的其他第三方主体或平台。
4. Partners: refer to social platforms used for third-party login, such as third-party information systems, payment institutions, WeChat/QQ/microblogs, etc. involved in the service provision process of Zhiyinlou, as well as other third-party entities or platforms that Zhiyinlou cooperates with to realize some functions and provide better customer service and user experience.
5.个人数据是指已识别或可识别的自然人（数据主体）相关的任何数据；可识别的自然人是指尤其通过姓名、身份证号、定位数据、网络标识符等标识符，或通过特定的身体、心理、基因、精神状态、经济、文化、社会等方面个人属性能够被直接或间接识别的自然人。
5. Personal data refers to any data related to identified or identifiable natural persons (data subjects); Identifiable natural persons refer to natural persons who can be directly or indirectly identified, especially through identifiers such as name, ID number, location data, network identifier, etc., or through specific personal attributes such as body, psychology, gene, mental state, economy, culture, society, etc.
6.特殊类型个人数据：涉及以下一种或多种类别的个人数据为特殊类型个人数据，即种族或民族背景、政治观点、宗教信仰、哲学信仰、工会成员信息、基因数据、为了特定识别自然人的生物识别数据、以及和自然人健康、个人性生活或性取向相关的数据。
6. Special types of personal data: personal data involving one or more of the following categories are special types of personal data, namely, racial or ethnic background, political views, religious beliefs, philosophical beliefs, trade union membership information, genetic data, biometric data for specific identification of natural persons, and data related to the health of natural persons, personal sex life or sexual orientation.
7.个人数据删除：指在实现日常业务功能所涉及的系统中去除个人数据的行为，使其保持不可被检索、访问的状态。
7. Deletion of personal data: refers to the act of removing personal data from the system involved in the realization of daily business functions to keep it in a state that cannot be retrieved or accessed.
8.雇主：指注册、登录、使用本平台并获得管理权限的组织，包括但不限于法人、政府机构、其他组织、合伙或个体工商户等；雇主可以通过获得个人授权的途径替其成员注册企业账户。

Employer: refers to the organization that registers, logs in, uses the platform and obtains administrative authority, including but not limited to legal persons, government agencies, other organizations, partnership and individual businesses, etc.; Employers can register business accounts for their members by obtaining personal authorization.
9.企业账户：指由雇主邀请并获得其授权同意，作为雇主的成员而使用本平台的账户。
9. Enterprise account: refers to the account that is invited and authorized by the Employer to use the Platform as a member of the Employer.
10.假名化：是指以如下方式处理个人数据，即：除非使用额外信息，否则无法将个人数据连接到某个具体的数据主体，且上述额外信息应当被独立存储并受制于适当的技术和组织措施，以确保个人数据不会连结到某个已识别或可识别的自然人。
10. Pseudonym: refers to the processing of personal data in such a way that personal data cannot be connected to a specific data subject unless additional information is used, and the above additional information should be stored independently and subject to appropriate technical and organizational measures to ensure that personal data will not be connected to an identified or identifiable natural person.
11.匿名化：指通过对个人数据的技术处理，使得个人数据主体无法被识别，且处理后的信息不能被复原的过程。

12. Data processing: any one or a series of operations on personal data or a collection of personal data, whether or not it is carried out by automated means, such as data collection, recording, organization, construction, storage, adaptation or modification, recovery, query, use, disclosure through dissemination, distribution or other operations that enable personal data to be obtained, arranged or combined, restricted, removed or destroyed by others.

1.您理解并同意，享受知音楼服务过程中，您需自行准备相关设备且承担如下费用：
1. You understand and agree that in the process of enjoying the service of Zhiyinlou, you need to prepare relevant equipment and bear the following expenses:
1.1上网设备：包括并不限于电脑或者其他上网终端、调制解调器及其他必备的上网装置；
1.1 Internet access equipment: including but not limited to computers or other Internet access terminals, modems and other necessary Internet access devices;
1.2上网开支：包括并不限于网络接入费、上网设备租用费、手机流量费等；
1.2 Internet access expenses: including but not limited to Internet access fees, Internet equipment rental fees, mobile data charges, etc.;
2.本协议所称用户或您，需具有享受知音楼相关服务的民事行为及责任能力。
如您为儿童（年龄不满十六周岁的儿童，或成员国出于特定目的在法律上规定的更加低的年龄界限）或限制民事行为能力人、无民事行为能力人，请您务必在监护人或法定代理人陪同下阅读本协议并由监护人或法定代理人代理完成点击确认、同意行为。平台收集到点击确认、同意本政策操作记录即视为该同意行为系您的监护人或法定代理人作出且您及您的监护人或法定代理人已充分阅读、理解且接受本政策的全部内容，并与知音楼达成一致，本政策对您及您的监护人或法定代理人、知音楼均具有法律约束力。
2. The “user” or “you” mentioned in this Agreement shall have the civil act and liability capacity to enjoy the relevant services of Zhiyinlou. If you are a child (a child under the age of 16 or a person with a lower age limit legally prescribed by member states for specific purposes)or a person with limited or no capacity for civil conduct, please be sure to read this Agreement accompanied by your guardian or legal representative and be represented by your guardian or legal representative to click for confirmation and consent. When the platform collects the operation records of clicking for confirmation and agreeing to the Policy, it shall be deemed that the consent has been made by your guardian or legal representative and that you and your guardian or legal representative have fully read, understood and accepted all the contents of the Policy, and reached an agreement with Zhiyinlou, the Policy is legally binding on you, your guardian or legal representative, and Zhiyinlou.
3.您理解并保证，在使用本服务过程中所提供的资料均具有真实性、准确性，信息完整有效。如信息有变动的，应及时进行更新。如因前述原因导致您本人或第三人人身或财产受到损害，知音楼不承担责任。
3. You understand and guarantee that the information provided during the use of this service is authentic, accurate, complete and valid. If the information changes, it should be updated in time. If you or a third party suffer personal or property damage due to the above reasons, Zhiyinlou will not be liable for.
4.您理解并保证，您在享受知音楼相关服务过程中，不违背中华人民共和国大陆地区及其他所适用相关法律法规之规定，不利用知音楼服务从事非法行为。您将对您在知音楼内发布的所有信息及言论承担所有责任。

You understand and guarantee that in the process of enjoying the relevant services of Zhiyinlou, you shall not violate the relevant laws and regulations of the Mainland of the People's Republic of China as well as other applicable laws and regulations, and shall not use the services of Zhiyinlou to engage in illegal acts. You shall take full liability for all information and comments you make in Zhiyinlou.

1.知音楼严格按照本政策、欧洲《一般数据保护条例》及其他所适用的相关法律法规的约定收集、使用、储存和分享您的个人数据，本政策对个人数据保护相关内容未作明确约定的，以《一般数据保护条例》及其他所适用的相关法律法规约定为准。除因知音楼存在过错外，您自行承担使用知音楼服务产生的风险。您如因本人过错或行为而遭受人身损害、财产损害，造成第三方人身损害、财产损害或由第三人造成您人身、财产损害的，应当依法向责任主体追究法律责任，知音楼不承担相关责任。
1. Zhiyinlou collects, uses, stores and shares your personal data in strict accordance with the provisions of the Policy, the EU General Data Protection Regulation and other applicable relevant laws and regulations. If the Policy does not explicitly stipulate the relevant contents of personal data protection, the General Data Protection Regulation and other applicable relevant laws and regulations shall prevail. Except for those risks caused by the fault of Zhiyinlou, you shall bear the risks arising from the use of Zhiyinlou service. 2.知音楼将会尽其商业上的合理努力保障您在知音楼及服务中的数据存储安全，但是，知音楼并不能就此提供完全保证您的个人数据不会受到任何侵害。知音楼不对您在知音楼及服务中相关数据的删除或储存失败负责，您可根据自身需求自行备份知音楼及服务中的相关数据。
2. Zhiyinlou shall make every reasonable commercial effort to ensure the safety of your data storage in Zhiyinlou and services. However, Zhiyinlou cannot provide complete guarantee that your personal data will not be infringed. Zhiyinlou is not responsible for the deletion or storage failure of relevant data in Zhiyinlou and services. You can back up the relevant data stored in Zhiyinlou and services according to your own needs.
3.如您违反本政策，知音楼保留暂停或终止为您提供知音楼各项服务的权利，同时有权拒绝提供服务、关闭个人账号、清除或编辑内容、取消订单、删除各类不符合法律规定或不真实信息内容而无需通知用户。
3. If you violate the Policy, Zhiyinlou reserves the right to suspend or terminate the provision of various services of Zhiyinlou for you. In addition, Zhiyinlou has the right to refuse to provide services, close personal accounts, clear or edit content, cancel orders, and delete all kinds of information content that does not conform to legal provisions or is untrue without notifying users.
4.您理解并同意，本政策提供的个人数据保护措施仅适用于知音楼软件及相关服务。一旦您离开知音楼及相关服务，浏览或使用其他网站、服务及内容资源，我们即没有能力及义务保护您在知音楼软件及相关服务之外的软件、网站提交的任何个人数据，无论您登录、浏览或使用上述软件、网站是否基于知音楼的链接或引导。
4. You understand and agree that the personal data protection measures provided in the Policy are only applicable to the software of Zhiyinlou and related services. Once you leave Zhiyinlou and related services, browse or use other websites, services and content resources, we have no ability and obligation to protect any personal data submitted via software and websites other than the software and related services of Zhiyinlou, regardless of whether you log in, browse or use the above software and websites are based on links or guidance of Zhiyinlou.
5.您理解并同意：在使用本服务的过程中，可能会遇到不可抗力、技术风险等因素，使本服务发生中断，对于下述原因导致的合同履行障碍、履行瑕疵、履行延后或履行内容变更、数据丢失等情形，知音楼在法律允许的最大范围内免责：

5.1 因自然灾害、罢工、暴乱、战争、政府行为、司法行政命令等不可抗力因素。

5.2 您或知音楼的电脑软件、系统、硬件出现故障或其他原因导致您无法使用知音楼。

5.3因电力供应故障、通讯网络故障（包括但不限于电子通讯传达失败或延时、用于电子通讯的计算机程序对电子通讯的拦截或操纵）等公共服务因素或您自身因素（包括但不限于您操作不当、通过非知音楼授权的方式使用本服务）或第三人因素（包括但不限于受到计算机病毒、木马或其他恶意程序、黑客攻击的破坏、顾客的错误下单等错误操作）。
5.3 Due to power supply failure, communication network failure (including but not limited to failure or delay of electronic communication transmission, interception or manipulation of electronic communications by computer programs used for electronic communications) or your own factors (including but not limited to your improper operation, using this service through non-authorized means of Zhiyinlou) or third-party factors (including but not limited to the damage caused by computer viruses, Trojan horses or other malicious programs, hacker attacks, wrong orders placed by customers and other wrong operations).
5.4在知音楼已尽善意管理的情况下，因常规或紧急的设备与系统维护、设备与系统故障、缺陷、网络信息与数据安全、技术风险等因素。
5.4 Under the condition that Zhiyinlou has done its best in good faith management, due to the routine or emergency equipment and system maintenance, equipment and system failures, defects, network information and data security, technical risks and other factors.
5. 您知悉并理解，知音楼将最大程度履行合理的注意义务，维护知音楼数据准确性，但由于互联网技术因素等客观原因，知音楼可能会出现网页显示信息滞后或差错现象， 知音楼将将在发现后尽快进行修复。
5.5 You know and understand that Zhiyinlou will fulfill its reasonable duty of care to the greatest extent and maintain the accuracy of Zhiyinlou's data. However, due to objective reasons such as Internet technology factors, Zhiyinlou may have lag or error in the information displayed on the web page, and Zhiyinlou will restore it as soon as possible once such lag or error is discovered.
5.6 其他知音楼无法控制或合理预见的情形。

6. 下列情形下，非因平台故意或过失行为，平台将不承担任何责任：

6.2 任何由于黑客攻击、计算机病毒侵入或发作、因政府管制而造成的暂时性关闭等影响网络正常经营之不可抗力而造成的个人资料泄露、丢失、被盗用或被窜改等。
6.2 Any personal data disclosure, loss, embezzlement or tampering caused by force majeure affecting the normal operation of the network, such as hacker attacks, invasion or attack of computer viruses, temporary shutdown caused by government control, etc.
6.3 由于与知音楼相关的其他第三方产品或服务所造成之个人资料泄露及由此而导致的任何法律争议和后果。

7. 知音楼仅对因知音楼原因给用户造成的直接、实际损失依法承担相应的赔偿责任，不对任何间接损失、惩罚性赔偿承担责任。

Please note that some of the information types listed above are used alone, such as operation log information that cannot identify a specific natural person. 在此类情况下，平台会确保您的个人数据按照标准合同条款的内容在中华人民共和国境内得到足够同等的保护。

对于您合理的请求，我们原则上不收取费用，但对明显不合理或过分的的请求，尤其是重复的请求，我们将视情收取一定的合理费用。对于无端重复、需要过多技术手段（例如，需要开发新系统或从根本上改变现行惯例）、给他人合法权益带来风险或者非常不切实际（例如，涉及备份磁带上存放的信息）的请求，我们可能会予以拒绝。
For your reasonable requests, we do not charge a fee in principle, but for repeated requests that exceed the reasonable limit, we will charge a certain fee depending on the situation. We may refuse unreasonably repeated requests, or requests that require complex technical means (e.g. development of new systems or fundamentally change of existing practices is required), pose risks to the legitimate rights and interests of others, or are very impractical (e.g.back-up of information stored on tapes is required).

(7) Prevention, investigating, reconnaissance and prosecution of acts violating code of professional ethics;
（8）与本条（1）至（5）和（7）项规定的行使公权力相关的监控、检查或监管行为，即使这种关联是偶然的；
(8) Monitoring, inspection or supervision related to the exercise of public power stipulated in sub-paragraphs (1) to (5) and (7) of this article, even if such relevance is accidental;
（9）保护数据主体或者他人的权利和自由；

（10）行使民法上的请求权。

(VIII) How will the Policy be updated

知音楼有权在必要时修改本政策条款，并以平台内通知方式通知到您。您可以随时在本平台查阅修改后的最新版本政策。如您不同意修改后的政策，您有权终止对平台的授权。本政策更新后，如果您继续使用相应平台功能，即视为您已接受修改后的政策。
Zhiyinlou has the right to amend the terms of the Policy when necessary and notify you by means of platform notification. You can check the latest version of the revised Policy on the platform at any time. If you do not agree with the revised Policy, you have the right to terminate your authorization to the platform. After the Policy is updated, if you continue to use the corresponding platform functions, you will be deemed to have accepted the revised Policy.
对于重大变更，平台还会提供更为显著的通知（包括平台会通过邮件或应用内通知的方式进行意见征集、公告通知甚至向您提供弹窗提示）。
For major changes, the platform will also provide more significant notifications (including opinion solicitation by mail or in-application notification, announcement and even pop-up prompts).
本政策所指的重大变更包括但不限于：

1. 平台的服务模式发生重大变化。如处理个人数据的目的、个人数据的使用方式等；

本平台的一切著作权、商标权、专利权、商业秘密等知识产权，以及与本平台相关的所有信息内容（包括但不限于文字、图片、音频、视频、图表、界面设计、版面框架、有关数据或电子文档等）均受中华人民共和国大陆地区法律法规和相应的国际条约保护，知音楼或其关联公司享有上述知识产权，但相关权利人依照法律规定应享有的权利除外。
1. Zhiyinlou and its affiliated companies is the intellectual property right holders of this platform. All copyrights, trademarks, patents, trade secrets and other intellectual property rights of this platform, as well as all information related to this platform (including but not limited to text, pictures, audios, videos, charts, interface design, layout framework, relevant data or electronic documents.) are protected by laws and regulations of the People's Republic of China (excluding Hongkong, Taiwan and Macau) and corresponding international treaties. Zhiyinlou or its affiliated companies shall enjoy the above intellectual property rights, except the rights that the relevant right holders should enjoy according to law.
